Summer 2023 - Updates to Site Visit Requirements in SFSP
All CEs are required to visit any new site or a site with previous operational issues in the prior year within the first two weeks of operation. CEs are still required to conduct a full review of food service operations at each site within the first four weeks of operation, and thereafter, maintain a reasonable level of site monitoring. The final rule allows the food service review to occur at the same time as the site visit during the first two weeks of operation.
Summer 2023 - Area Eligibility for Closed Enrolled Sites
The "traditional" waiver that allowed closed enrolled SFSP sites to become eligible based on being located in a low-income area has been codified in the Code of Federal Regulations per the September 2022 Final Rule. However, CEs wishing to operate a closed enrolled site must provide justification for why they are not able to service the community.
Closed enrolled sites are eligible to operate if at least 50% of its enrollees are qualified for free or reduced-price meals as determined through the individual income eligibility of the children attending the site. However, per Final Rule, Streamlining Program Requirements and Improving Integrity in the Summer Food Service Program (SFSP), instead of determining the individual income eligibility of each enrolled child, a site may document its status as a closed enrolled site by using area eligibility data. CEs wishing to operate a closed enrolled site in an eligible area must provide justification for why the site is operating as closed enrolled as opposed to being open to the community.
SFSP Application Flexibilities for New CEs Already Operating NSLP/SBP and/or CACFP
Per the recent September 2022 Final Rule, new CEs in good standing in NSLP, SBP, and/or CACFP may be exempt from the lengthier SFSP application process that most new CEs must follow if they meet certain criteria.
SFSP Performance Standards Now Codified in the Code of Federal Regulations
TX-UNPS APPLICATION PACKET DUE DATES for SFSP
Application Packets or the Intake Form MUST BE submitted by the designated due date to be eligible for approval.
January 1, 2023:
The Intake Form located on squaremeals.org is accessible for SFSP potential applicants. The Intake Form should only be completed by potential applicants that have not previously participated in SFSP or were not approved to participate in SFSP in Program Year 2022
January 15, 2023:
Application Packets open in TX-UNPS.
March 15, 2023:
Last day to submit Application Packets in TX-UNPS to TDA if CE is requesting advance payments.
Application Packets submitted in TX-UNPS after this date will not be eligible to receive advance payments for summer 2023.
April 15, 2023:
Last day to submit the SFSP Intake Form via squaremeals.org to initiate the potential applicant review process. Last day to submit the SFSP Application Packet in TX-UNPS for all renewing SFSP CEs that are Not in Good Standing (including CEs with a temporary deferred Serious Deficiency [SD]) for SFSP 2022, CACFP 2022 and/or CACFP 2023.
May 2, 2023:
Last day to submit Application Packets for all other renewing CEs.
Advance payments are made monthly by June 1, July 15, and August 15. To receive an advanced payment, eligible CEs must submit requests according to the following submission dates below:
