PRESIDENT'S MESSAGE
As we approach the end of September, it's apparent that the pleasantries typically associated with the start of the year have faded away. Over the past week, ATA has been in communication with District leadership over various issues, such as:
- Advisory
- PE ratios at elementary schools
- Schedule - Elementary Counselors
- Evaluation
- Evaluatory PBIS surveys
- 8th-grade promotion activities
- Progressive discipline
- EL certification
- Campus supervisor shortages
- Community Schools
- IEP coverage
- Open enrollment
- Updates on H&W benefits
- Adjuct hours
ATA is dedicated to standing up for our members and the students we serve. We tackle a diverse range of challenges on a daily basis, and though some of these issues are still being resolved, we are always here to address them swiftly and effectively. Your unwavering support empowers us to represent your interests and achieve favorable outcomes.
I am grateful for the ongoing collaboration between ATA, Superintendent Jaramillo, Executive Cabinet, and managers. Despite occasional differences of opinion, our collective commitment to fairness and equity remains steadfast.
Lastly, I would like to remind everyone that Hispanic Heritage Month takes place from September 15th to October 15th. It's a time to celebrate the contributions, cultures, and histories of Hispanic and Latin Americans, and to reflect on how they've shaped our country's history and culture. REASONABLE ACCOMMODATION
The California Fair Employment and Housing Act requires AUSD to provide reasonable accommodation for employees with a physical or mental disability to allow you to perform the essential functions of your job. Under the ADA, a Reasonable Accommodation is any “modification or adjustment to a job, the work environment, or the way things are usually done during the hiring process.” The modifications to your job/work environment are meant to enable any person with a disability (whether temporary or permanent) to successfully perform their job duties to the same extent as someone without a disability.
Reasonable accommodations usually include (but are not limited to):
- Ramps
- Accessible Restrooms
- Ergonomic Workstations/Modifying the layout of a workspace
- Change of job duties/Job restructuring
- Leave for medical care (can be intermittent leave like days to go to see your doctor)
- Change in work schedules
- Relocation of work area
- Acquiring or modifying equipment
- Training materials
- Providing readers or interpreters
- Providing screen reader software
Once AUSD knows that you need an accommodation (either because you ask for one or they are aware of the possible need for one) they are required to initiate the “interactive process.” AUSD might become aware of such a need either by a third party, observation (ex. you are using crutches), or because you have exhausted leave benefits.
In CA, it is unlawful for any employer to fail to engage in a timely, good faith, interactive process. This process requires an individualized assessment of both your specific job/position and specific physical and mental limitations related to the need for a reasonable accommodation. AUSD is not allowed to simply deny your request for accommodation request without going through this process.
Please note that if you have a disability/injury (either temporary or permanent) and do not need an accommodation, there is no requirement for you to provide AUSD with any information or doctor’s notice.
On a related note, if you are injured at the job, you are required to let AUSD know. This initiates the workers compensation process. ATA urges all members to fill out district paperwork so, if you are injured on the job, you go to your own physician instead of a workers compensation doctor. The process is lengthier if you do not have your own doctor on file BEFORE an on-the job injury.
If you need an accommodation or were injured on the job, please call ATA as soon as possible. We will guide you through the process and, if needed, provide you with attorney referrals (for workers compensation) or assign you legal assistance (for denials of accommodations).
Lastly, if you are ever requested to share a note from your doctor with the District or are considering doing so, please don't hesitate to contact ATA for guidance and support.

ATA GENERAL ELECTION
We have a submission for the position of Elementary Segment Director. Voting will occur online from September 25-27, 2023. You will receive an email from SimplyVoting, our secure, hosted online elections provider. Please make sure we have your correct personal email. It's not too late for non-paying dues members to vote. Email us ASAP so we can sign you up for membership.
The results will be announced on September 29, 2023, via this newsletter. If a run-off election is necessary, this will be included in the announcement with a run-off election timeline.
Elementary Segment Director (unexpired term)
OPEN ENROLLMENT - 2023-2024
Open Enrollment for the 2023-2024 year will be taking place from September 25, 2023, to October 20, 2023. Any changes made during this period will come into effect from November 1, 2023. If you're looking to make changes to your coverage or enroll in the Flex Spending medical or childcare programs, now is the perfect time to do so. It's important to take some time to review the different coverage options available to ensure that you have the best coverage to meet your health needs. Note that if you're not making any changes to your coverage(s), there's no need to take any action. For more information, refer to the 2023-2024 AUSD Benefits Guide.
UNDERSTANDING THE GRIEVANCE PROCESS
To ensure fairness and equality, I would like to provide some clarity on the grievance process. Essentially, it involves a unit member submitting a written allegation that their contractual rights have been infringed upon. It is important to note that a grievance is not a declaration of hostility or animosity, nor should it be interpreted as such. Rather, it is a formal way to address any differences that may arise between unit members and administration. When used correctly, it can help to peacefully solve problems and foster a positive workplace environment for everyone involved.
