Texas Summer Mandate
2024 Summer Food Service Program
Overview
Texas law (Agriculture Code, Title 2, Chapter 12, Section 12.0029) requires public school food authorities (SFAs) with 50 percent or more of enrolled students eligible for free or reduced-price meals in the National School Lunch Program to operate a Summer Nutrition Program (SNP) to provide meals to students in need for a minimum of 30 calendar days during the summer months.
Declare Intention or Submit Waiver by Jan. 31
FORM AVAILABLE IN TX-UNPS NOV. 1
Requesting a waiver?
If requesting a waiver, state law requires the board of
trustees to send written notice of the district's intention to
the district's local school health advisory council no later
than November 30. The notice must include an
explanation of the district's reason for requesting a waiver
of the requirement.
Non-Congregate Meals in 2024
Some districts are mandated by state law to provide summer meals or receive a waiver. Districts that are planning to request a waiver for summer 2024 should evaluate the summer rural non-congregate meal service as an option. TDA will host a webinar Thursday, Nov. 9, 2023, on this topic. To request a link to that event, please send an email to SNPWaivers@TexasAgriculture.gov.
