Special Edition - Feb. Weekend/Evening Field Trips - 1st - 5th Grades
A note from the principal
Dear Park Brook Families,
In February we have four weekend or evening field trips. The purpose of this newsletter is strictly to inform parents of these opportunities. There are opportunities on weekends for students in 1st - 5th grades.
Permission slips will be sent home today, Friday, January 10, 2025.
There are three field trips on Saturdays, and for those field trips we are requiring a $5 commitment fee for each family for each field trip. Please list all kids in your family on one permission slip. Please call the school by noon on the Friday before the field trip and your commitment fee will be returned; our purpose is not to keep funds, but to have an accurate count of students attending to reduce costs.
The waivers for these field trips are at the bottom of this newsletter. When you sign the permission slip, you will indicate that you have read and agree with waiver, including initials if required. (The waiver does not need to be printed.)
I would be remiss if I did not publicly thank the staff who willingly chaperone these weekend/evening experiences, along with conferences in February and not to mention Park Brook Winter Funland (information coming soon). I see the benefit for our students, desire the best for our students, and know that it is an additional time commitment for staff at Park Brook Elementary.
Transportation is provided to/from Park Brook Elementary.

Luminary Loppet
The Luminary Loppet is a spectacular event held at Lake of the Isles in Minneapolis. The current price for each ticket is $27 for every adult and $15 for every child. The Loppet Foundation has kindly provided tickets for staff chaperoning and students at Park Brook Elementary to attend for free. Everyone attending is required to have a ticket.
The Loppet Foundation comes to Park Brook every week to provide cross-country ski lessons for all students in grades 3 - 5. In addition, The Loppet Foundation has provided Park Brook with new cross country skis and boots, pays for the buses for the field trips on January 15 (during the school day) and February 1 Next Gen Ski Race, and has provided other opportunities for students at Park Brook over the years.
The Luminary Loppet is their fundraiser to enable them to provide opportunities, such as listed above, for students. There are many volunteers who work to make this magical evening possible, and in turn provide funds for school events.
This year we reached out for opportunities for the choir and our Park Brook Choir will sing at this event. Prior to the pandemic the choir sang at nursing homes, shopping malls, and so on. After the pandemic we began the Choir, Cookies and Cocoa event. We will continue to seek out unique opportunities for the choir. The choir will sing for families on March 19 at 5:30 p.m.
The Luminary Loppet consists of luminaries made out of ice, fire dancers, music, and more.

- This opportunity is free for Park Brook Students. A generous donor donates a significant amount of money to the YMCA for this event, however, with the donation the donor states that Park Brook Students must attend for free. (Park Brook Elementary provides the buses.)

Girls on the Run
Girls on the Run - GOTR - Girls in Grades 3 - 5
Registration Coming Soon!
Registration is coming soon for the spring session of GOTR. From February 1 until February 7 families can register girls for the lottery which will take place on February 8. After February 8, families will be able to register girls for any remaining spots. Click on the blue button for more information.
The registration for GOTR at Park Brook is completed through Girls on the Run Minnesota, not through Park Brook.
$5 Commitment Fee
A $5 commitment fee is required with the permission slip for the following field trips:
- Next Gen Ski Race
- Luminary Loppet
- Kidarod
The commitment fee has allowed us to have the correct number of buses, staff and so on. Typically, elementary schools offer field trips during the school day, Park Brook offers field trips outside of the school day. The commitment fee helps parents/guardians realize that the trip is outside of the school day, and parents/guardians call to let us know if their child is not going to be able to attend. Prior to the commitment fee, we spent money on buses we did not need, which can be several hundred dollars, and other expenses for these trips based upon the number of students attending.
Typically we require a $5 commitment fee for each student. We have several trips in February so we are only requiring a $5 commitment fee for each for family for each field trip. We are thankful that we have greatly reduced the number of students who do not show up for field trips, which is the purpose of the commitment fee.
Kidarod 2024
Return Time - Park Brook Webpage and PB Facebook
Return times are approximate and we attempt to return at that specific time. However, it sometimes takes longer with drive time or for students to complete events such as the Kidarod. When we are in the bus and on our way back to Park Brook, a message will be posted on Facebook which will automatically load to the Park Brook Website as well. Please check Facebook or the website to know when we will be returning to Park Brook.
Students will NOT be permitted to walk home alone or in groups following the Luminary Loppet, Kidarod and Minneapolis Bouldering Project Field Trips. It will be dark, cold, and as soon as students have left, staff leave as well which means there is not a place for students to return to if no one is at home by chance.
Waivers
Waivers for The Loppet Foundation, Minneapolis Bouldering Project and YMCA of the North are below. When signing permission slips you are indicating that you agree with the waiver that pertains to the field trip, as well indicating that you have read and agree with each and every that require an initial.
A printed copy of any and all requested waivers will be sent home upon request.
The waivers do not have to be printed.
The Loppet Foundation Waiver
Loppet Adventures ASSUMPTION OF RISK, RELEASE OF LIABILITY AND PHOTOGRAPHY RELEASE. READ BEFORE SIGNING. I understand that triathlons, cross-country skiing, skijoring, running, trail running, roller skiing, paddling, cycling, mountain biking, ice bike and snow bike racing, orienteering, in-line skating, events on ice, as well as preparation for participation in, coaching, volunteering, officiating and related or similar activities in competitions, camps, trainings and clinics (hereinafter collectively referred to as "Activities"), involve many RISKS, DANGERS and HAZARDS. These risks, dangers, and hazards include but are not limited to, changing weather, variations in steepness or terrain, natural and man-made obstacles and structures, falling through or on ice, equipment failure, collisions with objects or structures, being struck by competitors/riders or equipment, coming in contact with one or more persons infected with the novel coronavirus, SARS-CoV-2, contracting a communicable disease, including the potentially life-threatening COVID-19, and exceeding one's own abilities. I further understand that competition may be more hazardous than recreational activity. I understand that INJURIES OF ALL TYPES ARE A COMMON AND ORDINARY OCCURRENCE of the Activities. I know that the risk of SEVERE INJURY and even DEATH exists in the training and competition for the Activities. I also know that personal training, coaching, instruction, supervision, and enforcement of rules by the Loppet Foundation and Loppet Adventures, and their respective subsidiaries, affiliates, officers, directors, volunteers, employees, coaches, contractors and representatives, local ski clubs, competition organizers and sponsors, and facility operators (hereinafter the term "Foundation" shall be used to refer to all such persons and entities collectively) do not and cannot guarantee my safety.
In addition, the undersigned acknowledges that SARS-CoV-2 infections have been confirmed throughout the United States, including numerous cases in Minnesota and Wisconsin. In accordance with the most recent guidance and protocols issued by the World Health Organization (WHO), the Centers for Disease Control and Prevention (CDC), the Minnesota Department of Health (MDH), for slowing the transmission of SARS-CoV-2 and the COVID-19 disease, the undersigned hereby agrees, represents, and warrants that neither the undersigned nor my participating children or children that I am guardian of and that I am signing on behalf of (hereafter “participating children”) shall visit or utilize the facilities, services, and programs of the Loppet Foundation (other than any exclusively online services and programs) within 14 days after (i) returning from highly impacted areas subject to a CDC Level 3 Travel Health Notice, (ii) exposure to any person returning from areas subject to a CDC Level 3 Travel Health Notice, (iii) exposure to any person who has a suspected or confirmed case of COVID-19, or exhibiting COVID-19 or flu-like symptoms. The CDC website maintains both a list of Level 3 Travel Notices and a list of COVID-19 symptoms and is continuously updating these lists.
The undersigned agrees on behalf of himself/herself/themself and participating children that they are aware of these lists and the countries and symptoms listed. The undersigned agrees to check the CDC Travel Health Notices list (https://www.cdc.gov/coronavirus/2019-ncov/travelers/map-and-travel-notices.html) and the CDC Symptoms list (https://www.cdc.gov/coronavirus/2019-ncov/symptoms-testing/symptoms.html) prior to utilizing the facilities, services, and programs of the Loppet Foundation, on a daily basis if necessary. The undersigned hereby agrees, represents, and warrants that neither the undersigned nor participating children shall visit or utilize the facilities, services, and programs of the Loppet Foundation if he, she, or they (i) experience symptoms of COVID-19, or (i) has a suspected or diagnosed/confirmed case of COVID-19. The undersigned agrees to notify the Loppet Foundation immediately if he, she, or they believes that any of the foregoing access/use restrictions may apply.
The Loppet Foundation has taken certain steps to implement recommended guidance and protocols issued by the Public Health Agencies for slowing the transmission of COVID-19, including, without limitation, the access/use restrictions set forth above. The undersigned acknowledges and agrees that the Loppet Foundation may revise its procedures at any time based on updated recommended guidance and protocols issued by the Public Health Agencies and further agrees to comply with the Loppet Foundation's revised procedures prior to utilizing the facilities, services, and programs of the Loppet Foundation. The undersigned further acknowledges and agrees that, due to the nature of the facilities, services, programs, and Activities offered by the Loppet Foundation, the Loppet Foundation cannot guarantee either that such recommended guidance and protocols will be followed at all times, or that such guidance and protocols, even when followed, will necessarily protect against exposure to SARS-CoV-2 and the COVID-19 disease. Without limitation, social distancing of 6 feet per person among children and their caregivers in a childcare setting may not be possible. The undersigned fully understands and appreciates both the known and potential dangers of utilizing the facilities, services, programs, and Activities of the Loppet Foundation and acknowledges that use thereof by the undersigned and/or participating children may, despite the Loppet Foundation's efforts to mitigate such dangers, result in exposure to SARS-CoV-2 and the COVID-19 disease, which could result in quarantine requirements, serious illness, disability, and/or death. While the undersigned, on behalf of himself/herself/themself and participating children agree to follow all guidelines, protocols, and instructions of the Loppet Foundation personnel, the undersigned and his/her/their participating children understand and agree that they are responsible for their own safety and efforts to avoid exposure to SARS-CoV-2 and the COVID-19 disease, and are not relying on the Loppet Foundation in this regard.
With full knowledge and understanding of the RISK OF SEVERE INJURY AND DEATH involved in competition, I FREELY AND VOLUNTARILY ACCEPT AND FULLY ASSUME THE RISK THAT I MAY SUFFER TEMPORARY, PERMANENT OR EVEN FATAL INJURIES, even if I follow the instructions or advice of the Foundation. In partial consideration of the acceptance of my registration for Activities and/or competition, and in spite of the risk of severe or permanent injury, or even death, the undersigned (hereinafter "Participant") agrees to comply with and be bound by the following terms at all times, whether participating, training or practicing for competition, or in competition for the Activities.
1. Participant hereby unconditionally WAIVES AND RELEASES ANY AND ALL CLAIMS, AND AGREES TO HOLD HARMLESS, DEFEND AND INDEMNIFY The Loppet Foundation, Loppet Adventures, the City of Minneapolis, the Minneapolis Park & Recreation Board, the Minneapolis Public Schools, the Minneapolis Department of Community Education, Trips for Kids, True North Adventures, the Greenway Coalition, Wheel Fun Rentals, Loppet sponsors, the City of Golden Valley, the Courage Center, the Minnesota Orienteering Club, the Minnesota Youth Ski League, Wilderness Inquiry, Recreational Equipment, Inc., the Minikahda Club, BNSF Railway, and Canadian Pacific Railway, Hennepin County, City of Robbinsdale, Three Rivers Park District, Twin Cities and Western Railroad Company (together, “Organizers” or “The Organizers”) FROM ANY CLAIMS, present or future, known or unknown, to Participant or his/her/their property, or to any other person or property, for any loss, damage, expense, or injury (including DEATH), including any transportation to or from the site of the Activity, suffered by any person from or in connection with Participant’s participation in any Activities in which The Organizers are involved in any way, due to any cause whatsoever, INCLUDING NEGLIGENCE and/or breach of express or implied warranty on the part of the Organizers. Participant agrees not to sue or make a claim against any of the Organizers for any loss, harm, injury, or death that may occur during or after the Activity. I also promise to INDEMNIFY, HOLD HARMLESS, AND DEFEND the Organizers against any and all claims for my own negligence and any other claim arising from my acts or failure to act during the Activities. I further agree that in the event of my death or disability, the terms of this agreement, including the indemnification obligation in this Section, will be binding on my estate and my personal representative, executor, administrator, or guardian will be obligated to respect and enforce them.
2. Participant hereby RELIEVES the Organizers OF ANY DUTY TO PROTECT PARTICIPANT FROM HARM in connection with any Activities in which the Organizers are involved in any way. Participant also understands and agrees that any equipment used or borrowed from an Organizer is used at Participant’s own risk and such equipment is provided without any warranty regarding its condition or suitability.
3. Participant authorizes The Foundation to obtain medical care for, or transport him/her/them to a medical facility or hospital if, in the opinion of The Foundation, medical attention is required and the Participant is unable to make such decisions for himself/herself/themself. Participant agrees to pay all costs associated with such medical care and related transportation and shall DEFEND, INDEMNIFY, AND HOLD HARMLESS The Foundation of and from the consequences of such decision and from any such costs incurred relating to the provision of medical care.
4. Participants agree never to utilize any run, course, or facility for any training, practice, or competition without first conducting his/her/their thorough visual inspection of the run, course, or facility. Participant agrees to follow the rules and directions provided to Participant by the leaders or instructors of the Activities.
5. This Agreement shall be construed in accordance with, and governed by the substantive laws of, the State of Minnesota (for any injury or dispute arising out of a Loppet Foundation activity), without reference to principles governing choice or conflicts of laws. In addition, Participant agrees that all lawsuits for personal injury or related loss against the Organizers must be maintained in state courts sitting in Hennepin County, Minnesota, or federal district courts sitting in the District of Minnesota and Participant consents and agrees that jurisdiction and venue for such proceedings shall lie exclusively with such courts. In the event any portion of this release is found to be unenforceable, the remaining terms shall be fully enforceable.
6. Participant agrees to allow the Organizers to use his/her/their photograph and videography for any and all promotional purposes.
HAVING CAREFULLY READ AND UNDERSTOOD THE FOREGOING AND UNDERSTANDING IT TO BE A LEGALLY BINDING RELEASE AND INDEMNITY AGREEMENT, THE PARTICIPANT SIGNIFIES HER/HIS/THEIR ASSENT TO THE ABOVE TERMS BY SIGNING BELOW.
SIGNATURE OF PARENT OR GUARDIAN REQUIRED BELOW FOR MINOR PARTICIPANTS As the parent or guardian of the minor Participant named above, I hereby make and enter into each and every agreement, representation, waiver and release described above on behalf of myself, the Participant, and any other parent or guardian of the Participant, intending that they be binding on me, the Participant, and our respective heirs, executors, administrator and assigns. I intend to give up my right, the Participant's right, and the right of any other parent or guardian to maintain any claim or suit against the Organizers arising out of the Participant's involvement in any Activities involving the Organizers in any way. I believe and represent that I HAVE LEGAL AUTHORITY TO MAKE THESE AGREEMENTS, REPRESENTATIONS, WAIVERS AND RELEASES, AND I AGREE TO DEFEND AND INDEMNIFY the Organizers from and against any and all liability arising out of any lack of authority on my part to legally bind the Participant, or any unenforceability for any reason of the above agreements, representations, waivers and releases made by or on behalf of the Participant.
I UNDERSTAND THAT CHECKING THE BOX BELOW CONSTITUTES A LEGAL SIGNATURE CONFIRMING THAT I ACKNOWLEDGE AND AGREE TO THE ABOVE TERMS.
SIGNATURE OF PARENT OR GUARDIAN REQUIRED BELOW FOR MINOR COMPETITORS As the parent or guardian of the minor Competitor named above, I hereby make and enter into each and every agreement, representation, waiver and release described above on behalf of myself, the Competitor, and any other parent or guardian of the Competitor, intending that they be binding on me, the Competitor, and our respective heirs, executors, administrators and assigns. I intend to give up my right, the Competitor's right, and the right of any other parent or guardian to maintain any claim or suit against COLNSF arising out of the Competitor's participation in any Activities involving COLNSF in any way. I believe and represent that I HAVE LEGAL AUTHORITY TO MAKE THESE AGREEMENTS, REPRESENTATIONS, WAIVERS AND RELEASES, AND I AGREE TO DEFEND AND INDEMNIFY COLNSF from and against any and all liability arising out of any lack of authority on my part to legally bind the Competitor, or any unenforceability for any reason of the above agreements, representations, waivers and releases made by or on behalf of the Competitor.

Minneapolis Bouldering Project
MINNEAPOLIS BOULDERING PROJECT,
LLC RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, COVENANT NOT TO SUE AND HOLD HARMLESS AGREEMENT
What you are about to read and are requested to sign is a waiver and release of liability. Upon signing it, you will give up your right to sue Minneapolis Bouldering Project (“MBP”) or anyone associated with MBP for injuries or losses you suffer while using MBP facilities or while participating in activities at MBP facilities, including but not limited to facilities at 1433 West River Road North in Minneapolis, Minnesota 55411.
Please take your time and read this agreement very carefully. When you are certain that you understand the importance of each paragraph, sign your initials in the space provided. Sign the document only after you have read and understand everything. If you have any questions about the agreement, consult your attorney. Thank you for your attention to this matter.
YOU WILL NOT BE ALLOWED TO PARTICIPATE IN ANY ACTIVITIES AT MINNEAPOLIS BOULDERING PROJECT WITHOUT THE SIGNED WAIVER. I UNDERSTAND THAT SIGNING THIS DOCUMENT WILL PREVENT ME, MY HEIRS, EXECUTORS, DEPENDENTS, BENEFICIARIES AND ASSIGNS FROM SUING MBP, ITS OWNERS, OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS OR GUESTS FOR ANY INJURIES, INCLUDING DEATH AND PARALYSIS, OR DAMAGES THAT I MIGHT RECEIVE WHILE PARTICIPATING IN ANY ACTIVITIES WITH MBP OR AT MBP FACILITIES.

1. RISKS.
I understand that there is a significant risk of serious physical injury, death and other damages inherent in indoor and outdoor climbing, bouldering and physical fitness training activities and in my use of MBP facilities and instruction relating to these activities. These risks and hazards can include, but are not limited to, injuries arising from falling and striking objects or other people; being struck by falling objects or people; failure of any part or all of the climbing structures, flooring systems, building or training and fitness apparatus; defective, worn, uneven, separated or additional flooring or pads; hazards created by additional pads; falling and failing to land on a pad; landing on a pad and nonetheless suffering an injury; failure and/or breakage of climbing holds; failure of climbing hold anchoring systems and hardware; failure of anchoring systems, anchors and belay devices used to secure climbing anchors and ropes; falling because of improper use of ropes and safety equipment; injury resulting from lack of spotting, inadequate spotting or other spotting-related injury; injuries related to fitness training classes including without limitation yoga classes; risks associated with walking on streets and sidewalks to access MBP facilities; strained or sprained muscles, joints and connective tissue; broken bones; personal injury including paralysis, death, illness, property damage, and other losses. Injury or death can arise from errors in judgment, from lack of training or information, from the negligence of me, employees or agents of MBP or other parties, as well as the risks normally associated with athletic endeavors. There is no way to eliminate the risk of serious harm or death. 2. ACKNOWLEDGEMENT AND ASSUMPTION OF RISK OF INFECTIOUS DISEASE.
I understand and have familiarized myself with the dangers of COVID-19 and understand that participating in activities at this facility may subject me to exposure to and infection by COVID-19 or other infectious disease. I have read and agree to comply with all rules and recommendations of MBP facilities and applicable local, state and federal health authorities with respect to COVID-19 or other infectious disease. I acknowledge and understand that such rules may be inadequate to protect me from the risk of transmission of disease by or to others. I understand that state, federal, and local guidelines rapidly change, and that the rules and recommendations of MBP facilities therefore may not reflect the most recent health guidance. Notwithstanding the risks associated with COVID-19 or other infectious disease, including without limitation the risk of illness or death, which I readily acknowledge, I hereby willingly choose to participate in activities at this facility, AND I ACKNOWLEDGE AND FULLY ASSUME THE RISK OF ILLNESS OR DEATH TO MYSELF OR OTHERS RELATED TO COVID-19 OR OTHER INFECTIOUS DISEASE ARISING FROM MY PRESENCE AT MBP AND/OR PARTICIPATION IN ACTIVITIES AT MBP.

I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS INCLUDING BUT NOT LIMITED TO THOSE ENUMERATED IN THIS DOCUMENT, WHETHER KNOWN OR UNKNOWN, OF INJURY, ILLNESS, DEATH OR DAMAGE OF WHATEVER KIND ARISING OUT OF MY USE OF MBP FACILITIES OR EQUIPMENT OR MY PARTICIPATION IN ANY ACTIVITY AT MBP FACILITIES OR SPONSORED BY MBP.

4. I WAIVE AND RELEASE ALL CLAIMS.
I recognize that MBP could not offer this activity without obtaining a release of liability. In consideration of, and part payment for the right to use MBP’s facilities, I RELEASE MBP AND ANYONE ASSOCIATED WITH MBP, INCLUDING WITHOUT LIMITATION ITS OWNERS, OFFICERS, DIRECTORS, STAFF, INSTRUCTORS, MEMBERS, AGENTS, GUESTS AND THIRD PARTIES, FROM ALL LIABILITY, AND KNOWINGLY, INTENTIONALLY AND VOLUNTARILY WAIVE ALL CLAIMS, DEMANDS OR CAUSES OF ACTION OF ANY KIND WHATSOEVER, INCLUDING BUT NOT LIMITED TO ANY CLAIMS OF NEGLIGENCE, WHICH MAY ARISE AS A RESULT OF MY PARTICIPATION IN A MBP-SPONSORED ACTIVITY OR FROM USE OF MBP FACILITIES OR EQUIPMENT.

5. I WILL INDEMNIFY MBP.
In consideration of, and in part payment for the right to use MBP’s facilities, I agree to defend, protect, INDEMNIFY, and hold harmless MBP, its owners, officers, directors, members, instructors, employees, agents and guests from and against any and all claims, suits, actions at law or in equity, for damages or other relief and against any liability of any nature, together with attorneys' fees and costs incurred, that may arise out of my use of MBP property or facilities, INCLUDING BUT NOT LIMITED TO INJURIES ARISING FROM MY VIOLATION OF MBP RULES. I agree to pay the reasonable attorneys' fees and all other costs of all parties if I bring a suit for injuries suffered at MBP and that action is unsuccessful, in whole or in part. Additionally, in consideration of, and part payment for my right to participate in a MBP-sponsored activity, I EXPRESSLY AGREE NOT TO SUE MBP, ITS OWNERS, OFFICERS, DIRECTORS, MEMBERS, INSTRUCTORS, EMPLOYEES, AGENTS AND GUESTS AND HEREBY WAIVE ALL CLAIMS AND LIABILITIES AGAINST MBP AND THOSE PARTIES INCLUDING, WITHOUT LIMITATION, CLAIMS FOR NEGLIGENCE ARISING FROM MY (OR THE MINOR’S) PARTICIPATION IN CLIMBING ACTIVITIES OR USE OF MBP FACILITIES OR EQUIPMENT.

6. I AGREE TO ABIDE BY ALL MBP RULES.
I agree to abide by all MBP rules and codes of conduct including without limitation those contained in written or electronic and video form as well as verbal directions that may be given by MBP staff or employees. I MAY NOT USE MBP FACILITIES IF I AM UNDER THE INFLUENCE OF ALCOHOL OR OTHER DRUGS.

7. I AM PHYSICALLY QUALIFIED TO PARTICIPATE.
I certify that I have no physical limitations or medical conditions that would impair my ability to fully and safely use MBP facilities. I agree to inform MBP of any conditions that may have any effect on my ability to fully and safely use MBP facilities, so that a determination can be made as to the proper course of action.

8. OTHER PROVISIONS.
•This agreement constitutes the complete and sole agreement between you and MBP, its owners, officers, directors, instructors, employees, agents, members and guests and all others associated with MBP. Evidence of any other agreements, whether oral or in writing, are void and inadmissible and unenforceable in a court of law, arbitration or other dispute resolution proceeding.
• INDIVIDUAL OFFICERS, DIRECTORS, MBP MEMBERS, INSTRUCTORS, EMPLOYEES AND AGENTS HAVE NO AUTHORITY OR POWER TO ALTER THE TERMS OF THIS AGREEMENT, EITHER ORALLY OR IN WRITING. This agreement covers my use of MBP facilities as well as my participation in all MBP activities and all associated events.
• THE LAWS OF THE STATE OF MINNESOTA SHALL GOVERN THIS AGREEMENT. VENUE FOR ANY ACTION SHALL BE HENNEPIN COUNTY, MINNESOTA.

9. SEVERABILITY.
If any provision of this agreement or its application to any person or circumstance is held invalid or void, the remainder of the agreement or its application to other persons or circumstances is not affected. I AM FULLY AWARE OF THE CONTENTS OF THIS AGREEMENT AND RELEASE, AND HAVE READ AND UNDERSTAND ALL OF THE TERMS. THE TERMS OF THIS AGREEMENT BIND ME, MY FAMILY (INCLUDING BUT NOT LIMITED TO SPOUSES AND DOMESTIC PARTNERS), HEIRS, EXECUTORS, ADMINISTRATORS, DEPENDENTS, BENEFICIARIES AND ASSIGNS. I recognize that if I have any questions regarding my waiver of rights, I should consult an attorney.
YMCA Waiver
Although I understand YMCA of the North is undertaking all possible efforts to produce safe and fun events for participants, I know that participating in an adventure race or triathlon is a potentially hazardous activity, which could cause injury, bodily harm, or even death. By my signature below, I certify that the participants I have registered are able to participate in this event, are in good health, physically fit for outdoor activity, and are adequately clothed for participation in an outdoor event. I agree to abide by any decision of a race official relative to any aspect of participating in this event, including the right of any official to deny or suspend participation for any reason whatsoever. I attest that I have read the description of the race and have the authorization to register and sign this waiver on behalf of participant/s or myself I am registering. On behalf of myself, my child/ren, and others that I am registering, I assume all risks associated with participating in this event, including but not limited to: trips, falls, slips, contact with other participants, the effects of the weather, including rain/cold/snow/ice, traffic and the conditions of the park, including trails and hills, illness and all other risks. I understand and agree that I will use my own insurance and that all participants that I am registering will use their own insurance should an injury or illness occur as a result of my participation. Having read this waiver and knowing these facts and in consideration of your accepting my entry, I, for myself and anyone entitled to act on my behalf, waive and release the YMCA, Three Rivers Park District, all event sponsors, their representatives and successors from all claims or liabilities of any kind arising out of mine or my child/ren’s, or others that I am registering participation in this event, even though that liability may arise out of negligence or carelessness on the part of the persons named in this waiver. In addition, I grant permission to all of the foregoing to use photographs of me and my child/ren, or other participants that I am registering, motion pictures, recordings or any other record of this event for any legitimate purpose.
Photo Release
Please note: Park Brook is participating in events hosted by outside organizations. Park Brook Elementary is NOT hosting the events, but rather taking students to the events. The above waivers give permission for these organizations to use photos of participants for their purposes.
If a family has indicated that their child cannot be photographed by the school, we do our best to maintain that however, we are not responsible for photographs from the organizations we partner with and recognize that families have signed a release for the outside organizations to photograph their children. Typically outside organizations ask if any student cannot be photographed, but they are not legally bound to do so based upon the signed waivers.
These field trips are not required for attendance or part of the regular curriculum, are held outside of the school day, and parents/guardians have the full right to not have their children participate.
