New Board Member
Superintendent Schwiebert introduced the new member to Cambrian’s Board of Trustees, Mr. Sergio Martinez.
Mr. Martinez’s journey to this moment is one that truly reflects the values of our community. Twenty years ago, he arrived in the Bay Area to pursue a degree in Political Science at Santa Clara University.
Like so many others, he quickly fell in love with this region and chose to make it his permanent home.
Throughout his career in Human Resources, Mr. Martinez has always recognized the importance of education and the role it plays in shaping the future. As a proud Cambrian resident, he is deeply invested in our schools—not just as a Board Member, but as a parent. His children currently attend Ida Price Middle School and Sartorette Elementary, and they previously attended Farnham and Fammatre Elementary. He understands firsthand the impact of a strong public school system and believes deeply in its ability to transform lives.
We are grateful for Mr. Martinez’s commitment to our schools, and we look forward to working alongside him to continue making a difference in the lives of our students. Welcome aboard!

Adoption of Consent Agenda Items
The Governing Board voted to accept the consent agenda items. Items listed under the consent agenda motion are considered to be a regular course of procedure and are acted on by the Board of Trustees in one motion.
There is no discussion of these items prior to the Board vote unless a member of the Board, staff, or the public requests specific items be discussed and/or removed from the agenda. It is understood that the administration recommends approval on all consent items. Each item on the consent agenda approved by the Board of Trustees shall be deemed to have been considered in full and adopted as recommended.

Student Services: Transportation Plan 2024-25
The Governing Board approved the 2024-25 Transportation Plan as part of the Consent Agenda. On July 10, 2023, California added Education Code 39800.1 which requires school districts to develop a plan describing the transportation services it will offer to its students, and how it will prioritize planned services for students in transitional kindergarten, kindergarten, and any of grades 1 to 6, inclusive, and students who are low income. In exchange for developing the plan, the state will fund Transportation at 60% of our costs.

The Governing Board accepted the Board Warrant as part of the Consent Agenda. he Governing Board is committed to ensuring public accountability and the district's fiscal health. The Board Warrant Approval List is a detailed list of payees and expenditure amounts.

Property Redevelopment
The Governing Board approved the Fourth Amendment to the Exchange and Joint Escrow Agreement with Silverado San Jose, Inc. On March 17, 2022, the Governing Board approved Resolution 21-22-06: Intent to Exchange Interests in Real Property with Silverado Memory Care. The Fourth Amendment is to extend the closing of escrow from January 31, 2025, to on or prior to May 31, 2025, due the approval from the City of San Jose Planning Commission.

Budget: Second Interim Report for 2024-25
The Board, having reviewed the Interim Report, which reveals pertinent financial and budgetary information,
(1) approved the Second Interim Report
(2) found that the District will be able to meet its financial obligations through June 30, 2025, and the two subsequent fiscal years, and,
(3) authorized the Board President to certify and file a "positive" financial certification statement with the Santa Clara Office of Education.
Education Code Sections 42130 and 42131 require school district governing boards to certify their district's projected year-end and subsequent years' financial condition twice a year, First Interim (July 1 – October 31) and Second Interim (July 1 – January 31). The certification shall be based upon required financial and budgetary reports, cumulatively entitled the "Interim Report". There are three possible “certifications” that can be made: (1) positive certification, meaning the District will meet its financial obligations for the current fiscal year and subsequent two fiscal years; (2) qualified certification, meaning that if certain events do or do not occur, the District may not meet its financial obligations for the current fiscal year or two subsequent fiscal years; and (3) negative certification, meaning that the District will be unable to meet its financial obligations through fiscal year-end or two subsequent years.
After reviewing the Interim Report, the County Office of Education can either agree with the Board’s Certification, or disagree and make a change to the Board’s Certification, and shall notify the District within 75 days after the close of the reporting period of their review. Chief Financial Officer, Dr. John Pappalardo, presented the Second Interim Report.

California School Boards Association's Delegate Assembly Election
The Governing Board was presented with potential delegates for the CSBA Assembly Election. They voted for four (4) candidates for the California School Boards Association Delegate Assembly 2025-27 Term: Van Le, Naomi Nakano-Matsumoto, George Sanchez, and Vaishali Sirkay. The California School Boards Association Delegate Assembly is a vital link in the governance structure and ensures that the association reflects the interests of school districts and county offices of education throughout the state.
Nominations for the Delegate Assembly were submitted by January 7, 2025, and attached are the candidates biographical sketches. The Governing Board of Trustees may vote for up to four (4) candidates, with no more than one vote per any one candidate. The ballot also contains a provision for write-in candidates.
All re-elected and newly elected Delegates will serve two-year terms beginning April 1, 2025, through March 31, 2027.

One of the roles of the Governing Board is to ensure District Board policies are reviewed, added, removed and kept up to date in order to keep the District legally compliant.
Since May 2024, the District staff, the Board Policy Committee, and the California School Board Association have been working to update all Board Policies, Regulations, and Bylaws. The attached Community Relations - 1000 Series list contains new or amended policies and regulations.
The current following policies and regulations will be obsolete once approved due to changes in the laws: Regulation 1000, Policy 1200.0, Policy 1200.2, Policy & Regulation 1310, Policy 1312, Policy 1312.4, Policy & Regulation 1320, and Policy 1331.

The Governing Board discussed the Business and Non-instructional Operations - 3000 Series policies and regulations. They pulled 3541.1 for further review and discussion, then approved the remaining new, amended, and removal of the obsolete Business and Non-instructional Operations - 3000 Series policies and regulations.
One of the roles of the Governing Board is to ensure District Board policies are reviewed, added, removed and kept up to date in order to keep the District legally compliant.
