From Your Executive Director
Educators play a vital role in fostering a safe and respectful environment for our students. In light of this responsibility, it is crucial to approach situations involving physical altercations among students with caution and consistency. In the following guidelines, aligned with California law, you will find important information and practical advice designed to support you in effectively managing these challenging situations while safeguarding the rights and well-being of all students involved. Remember, our goal is to promote a positive learning atmosphere, and these guidelines will serve as a valuable resource in navigating these incidents. Please take a look at this information carefully, and remember that ATA is here to support you every step of the way.
Please note that this message is a general guide, not legal advice.

CA Ed Code 56046(a)
Did you know that California Education Code 56046(a) protects educators and school staff from intimidation or coercion when advocating for students with special needs?
No district employee—whether directly or indirectly—may use their position to intimidate, threaten, or coerce any individual, including teachers, related service providers, paraprofessionals, aides, contractors, or subordinates, for assisting a parent or guardian in securing services or accommodations for a special education student.
Advocating for students is not just the right thing to do—it’s protected by law. If you ever feel pressured to stay silent or discouraged from supporting a family in accessing appropriate services, know that you have legal protections.
Have questions or concerns? Reach out to ATA—we’re here to support you.
