Stonewall Chico's Official Policy on ICE (Immigration & Customs Enforcement)
Stonewall Chico has a new policy to announce about what you can expect and plan for if ICE — Immigration and Customs Enforcement — comes to our offices or events while you are there. We suggest that other organizations and spaces do the same.
OUR PROMISE TO OUR COMMUNITY:
a. Your use of our services is confidential and we will not report your information to any federal agency.
b. We will not give ICE or Immigration agents permission to enter rooms in our Center past our front lobby without a judicial warrant signed by a judge.
c. We will do our best to warn people in our office or event spaces if ICE is spotted nearby.
d. Stonewall Chico will not give names, locations, or any other information about our community members to ICE agents.
e. We will do our best to get video or picture documentation of all interactions without interfering, as is everyone’s legal right.
WE KEEP STOCKED AND CAN PROVIDE RED CARDS. These are available if you ever need them at our office or events. Red cards are a simple script of your constitutional rights (citizens and non-citizens alike) so that you know exactly what to say to an ICE officer.
WHAT TO DO IF ICE SHOWS UP AT A STONEWALL EVENT OR OFFICE
a. DON’T RUN - this can be viewed as admission of guilt and ICE officers can behave aggressively.
b. Call our local Rapid Response hotline at 916-382-0256. They can send trained, professional help.
c. Ask ICE agents “Am I free to leave?” If you do not ask, the interaction is considered voluntary.
d. You have the right to remain silent and you have the right to refuse to provide them with any information, your signature, a search of your person or belongings, or entrance to your car unless they have a judicial warrant signed by a judge. An administrative warrant signed by other ICE personnel does NOT COUNT.
e. If you are a legally documented immigrant, it is a good idea to show your documentation to ICE agents to avoid arrest.
f. If you decide it is reasonably safe to do so, take a video on your phone.
Above is an example of an Administrative and a Judicial warrant.
If ICE wants access to your home or private space, wants to search you or your belongings or is telling you to answer questions, you do not have to comply if they cannot show you a Judicial warrant.
The example on the left is an Administrative warrant. The only thing an Administrative warrant gives agents is the ability to arrest non-citizens suspected of committing immigration violations. If that doesn't apply to you, neither does this warrant.
An Administrative Warrant:
a. Is signed by an immigration officer, not a judge or magistrate.
b. You can read at the top that it is issued by ICE or Immigrations.
c. Often (but not always) it is in the visual format you see here, with three signature lines on the lower right hand side.
Do not sign anything you do not understand or consent to!
The example on the right is a Judicial warrant. Notice that you can read at the top that it comes from a Federal Court, it has a case number, and it is signed by a judge.
If they have a Judicial warrant, you do need to comply with what the warrant order is for - but not anything else. Ask for a copy of the warrant so that you can read it carefully and know exactly what you are mandated to do. Be careful to note that if he warrant is more than 14 days old, does not specify the location/ person/ item at hand, or is not properly signed, the warrant does not apply to you and you are not obligated to comply with its order.
Now is a good time to put our local Migra Watch hotline, operated by @norcal_resist, into your phone: 916-382-0256.
If you see ICE in the community, call them right away. They can alert the community and send help.
Black History Month Pop-Up
Last month, we had an absolutely gorgeous day with community at the Black History Month Pop-Up event, co-hosted by @blacc.530. Huge thank you to the vendors, organizers, artists, donors, volunteers, and attendees who made this day great. Let's do it again next year!
