We encourage you to thoughtfully review the District's proposed changes and consider their potential effects on your personal situation. Your insights are highly valued, so please take the opportunity to communicate your thoughts to the bargaining team.
The November 19th, 2024, Bargaining Bulletin contains comprehensive information about the proposals from the initial negotiations between ATA and AUSD. If you have any questions or require further clarification, please feel free to contact the ATA Bargaining Team. Remember, you may submit one question per document and are welcome to send multiple inquiries.
Please submit your questions or concerns by December 6th, 2024, so the team can review them before the next meeting. Let’s ensure that our collective voices are recognized in this important process.

Teacher Grievance Advances to Mediation Amid Evaluation Dispute
On November 12th, the ATA Board of Directors made the decision to advance a teacher’s grievance from Level II to Mediation. This grievance pertains to the Evaluation of Performance process. Although the evaluation clearly identified the objectives met, it did not explicitly indicate whether the overall evaluation was considered unsatisfactory.
The contract includes specific provisions laid out in a side letter, which serves as a supplementary document clarifying certain aspects of the contract. This side letter explicitly defines an unsatisfactory evaluation, stating that it occurs when a unit member does not meet three out of four (3/4) or seventy-five percent of their objectives. However, the District has expressed that the language in the side letter is not enforceable within the framework of the collective bargaining agreement. Furthermore, the concluding paragraph of the teacher’s Evaluation of Performance did not provide clarity on whether a follow-up evaluation would be required in the subsequent year, contributing to the ongoing discussion.
This situation raises broader concerns regarding the consistent application of side letter provisions. For instance, a side letter related to Restructuring was successfully utilized to guide the implementation of advisory classes across all three high school campuses, without any challenges from the District about its enforceability. While the current grievance does not relate to advisory classes, the varying application of side letter provisions highlights important discussions about fairness and trust in our processes.
We anticipate that mediation will take place next month, and we are committed to keeping you updated as the process unfolds.
Understanding Insubordination
Insubordination is an important issue that can lead to employee discipline or dismissal. Therefore, employees need to understand its implications. Insubordination is defined as the "failure to obey authority," making it crucial to maintain professional conduct in the workplace.
If an employee has questions about a directive from a principal or supervisor, the best approach is to discuss those concerns directly with them. However, if the administrator insists on compliance, the employee must follow the directive, as long as it does not endanger their health or safety or that of others. In such circumstances, it is appropriate to follow up through the grievance procedure and/or seek assistance from your site rep.
It is also important to recognize the management rights of principals and supervisors. They are responsible for leadership, directing operations, and enforcing policies. Their directives should align with established agreements, be clear and fair, and avoid causing harm to anyone.
The principle of “work now, grieve later” is often the best approach when faced with potentially unreasonable orders. Although complying may seem difficult, it helps protect unit members from being accused of insubordination. In cases where rights are violated, creative resolutions, such as compensatory time, can help restore fairness.
Protecting Your Rights as an Educator
Educators are vulnerable to accusations of wrongdoing while on the job. If you ever find yourself in this situation, knowing your rights and how to protect them is crucial. Invoke your Weingarten Rights immediately and contact your union representative or the ATA office for support. Avoid the temptation to explain or defend yourself before speaking with your union representative. If law enforcement is involved, contact the ATA office immediately and wait to talk with them until you've spoken with ATA leadership. Enforcing your rights with the assistance of the ATA is critical in these circumstances.
