CARES Act ESSER Funding PNP Update
On Friday evening, September 4, 2020, a federal judge in the United States District Court for the District of Columbia issued an order striking down the CARES Act equitable services Interim Final Rule (IFR). The decision is an order for summary judgment vacating the IFR in its entirety nationwide. This order “vacates” the rule, leaving no IFR in place for USDE to enforce in any jurisdiction. It is unclear at this point whether USDE will appeal.
- The TEA CARES Act Equitable Services FAQ has been updated as of today, 9/11/2020.
- TEA strongly recommends LEAs follow revised CARES Act ESSER equitable services calculation requirements shared on the TEA’s COVID-19 Support: District Waivers, Finance & Grants webpage in the CARES Act Equitable Services FAQ document (dated 9/11/2020).
- LEAs should download and keep on file a copy of the September 11, 2020 CARES Act Equitable Services FAQ document (prior to September 16, 2020).
- Two common questions:
1. Who can now receive PNP equitable services?
Any PNP school that is non-profit and existed prior to March 13, 2020 is eligible for services.
2. What happens if the LEA calculated under option 1b or 2 originally and that was much more services than the new calculation, and the LEA has already provided more services to the PNP than the new calculation allows?
There is a strong argument to be made that funds already expended would be allowable given the reasonable reliance on the regulation in place at the time. However, that would only apply to funds expended prior to September 9, 2020. Since USDE posted on September 9, 2020, that the IFR was no longer in effect, expenditures after that date to the schools that should not have received an allocation or received too much may be called into question. This date might be arguably pushed to September 10, 2020, when TEA updated our guidance FAQ.
- Any remaining services not provided, or funds not expended should be included in the recalculation. LEAs should make best attempts to make corrections on funds and services all public and PNP schools should have received. This is where consultation is so critical. LEAs must keep dated documentation of consultations on file for federal and fiscal auditing purposes.
