Andrew Jackson signed into law the The Indian Removal Act on May 28, 1830." This law authorized the president assign unsettled lands to the Indians in exchange for the land in which they had already settled. During the fall and winter of 1838 and 1839, the Cherokees were forcibly moved west by the United States government.

In the 1830s, nearly 125,000 Native Americans lived on land that had been cultivated and occupied for generations by their ancestors. The Cherokees spanned across several states such as Alabama, Florida, Georgia, North Carolina, and Tennessee. Forcing these Native Americans to walk thousands of miles leaving their homelands, The federal government made the Cherokees live only on “Indian territory” located across the Mississippi River. known as the Trail of Tears, this migration was difficult and deadly.

signed on December 29, 1835, in New Echota, The Treaty of New Echota was a treaty that established terms for the Cherokee Nation to ceded its southeast territory. In the treaty, the Native Americans agreed to move west to an Indian Territory. The treaty was not approved by the Cherokee National Council, nor was it signed by Principal Chief John Ross. In March 1836, it was amended and ratified by the U.S. Senate. This document became the legal basis that would allow the forcible removal of the Natives known as the Trail of Tears.
