Dear Bermuda Bay Homeowner,
I want to sincerely acknowledge the disruption that our IT migration may have caused to our email and services. We fully understand the impact this may have had on communication within our community, and we are deeply sorry for any inconvenience this has caused.
I want to assure you that we are working tirelessly to resolve the issue and restore full functionality as quickly as possible. The Bermuda Bay office was fully restored this week. These improvements are designed to enhance communication and increase efficiencies, ultimately benefiting both our community and our operations.
We truly appreciate your patience and understanding during this time, and we remain committed to providing the best possible service to all of you. Any lingering issues can be given to Ray Ferreris and if he requires, I will engage to get quick resolution.

IT''S A CALL TO VOTE...MUST VOTE BEFORE DECEMBER 30, 2024
WE DID NOT GET ENOUGH VOTES - SO THE ANNUAL MEETING IS EXTENDED UNTIL DECEMBER 30
The annual meeting was held today, but unfortunately we did not have the votes to pass our proxy issues, so the annual meeting needs to be extended until December 30 in the hopes that EVERYONE will vote. We have many important issues that need a positive vote.
1. If you are a YES vote for amending 13.03, paragraph (4) of the Declaration - this means you would allow the Board to possibly make decisions on charging for limited amenities. The example has been charging for RV parking slots. This money would then go into the operating account and it has not been earmarked for any specific purpose, although it would be used to maintain the asphalt, painting of lines, etc. for those slots. The additional monies from this could be earmarked for other projects such as beach restoration, etc. This current board would be willing to do that, but we can not guarantee what future boards would do.
2. Do you want to roll over the 2024 surplus to the operating fund to avoid taxes by the IRS? I would encourage you to vote YES on this to avoid us paying additional taxes on money that we could use.
3. Should the Florida Statute concerning auditing be waived? We HAVE TO DO IT in 2025 (as this is required every three years...so no matter how you vote - we will have to have an audit.
4. Should the Florida Statute requirement for a fully funded reserve budget for the next fiscal year be waived in favor of a less than fully funded reserve budget? This would be a strong YES. We want to WAIVE IT...or our HOA dues will increase dramatically. A one bedroom could go anywhere from their $655.00 a month to around $995.00 a month. We do not want that increase in our monthly dues so vote YES to waive this so we DO NOT HAVE TO FULLY FUND OUR RESERVE.
5. Do you want to authorize the Board to use any and all available reserve funds in the event of a disaster or catastrophic event that causes damage to the common elements of our association? It is recommended to vote YES on this as well, so that we can use Reserve funds in an emergency situation.
If you misunderstood any of these votes, you will be able to change your vote if you are of a mind to do so. Please be on the lookout for an email blast when MyHOAst will be reopened for electronic voting and proxies will be made available in an attachment and in the newsletter next week. Please vote before December 30 when we reconvene the Annual meeting and hopefully will have a quorum to pass these votes one way or another. If you have any further questions, please feel free to reach out to the office. Especially if you had any electronic problems with MyHOAst - we want to get those issues rectified. IMPORTANT UPDATE REGARDING RESTORATION OF UNITS
While your UNIT is under the care of Rapid Response and its subcontractors, you should not be going into your unit. It a safety hazard and your unit is not cleared for you to walk around the construction area. If you slip and fall it will be an insurance disaster. I've read over a dozen emails from this weekend alone stating that their unit is very dusty and holes in the walls with coax cables hanging out of them. Yes, that is because they are still working. Please stay out of the construction zone which is now your units. We will notify you when it is safe to go back to your Units. Thank You
- Many calls and emails continue to come into the office with questions. As I mentioned previously when we receive any new information you will get it.
- Just to confirm, I emailed everyone the dates in which their units will begin being worked on. The dates may be exact or 1 or 2 days off, this all depending on the work that needs to done to the previous units.
- This is the process:
a. Once they begin working in the unit, they will remove the walls affected and begin the abatement to remove any asbestos. Both sides of the walls will be removed so you might be able to see inside of your neighbor’s unit.
b. When that job is complete, they will then wait for the inspector to test the air in the unit.
c. At this point they will clean the unit one last time and the Drywall will be installed.
3. When the Drywall is finished the unit will be turned over back to the owner. The office will contact each owner when it is ok to go back in and begin their own personal finishes.
4. Now the owner can choose to use Rapid Response (Elio Cruz -239-439-6211) or their own contractor to finish their unit to completion.
5. Funds for each unit owner will be put together by FEMA and the Adjuster and turned over to Bermuda Bay for proper disbursement Final numbers have been submitted and we hope to hear something in January 2025 on the amounts).
6. Air Conditioning Units have been inspected yesterday by ASA and a list is being submitted to the adjuster for either repair or replacement of the unit. Insurance will only cover the outside unit. ASA called the city to get the guidelines for the outside AC installations and they have made major changes. They said with the Base Flood Evaluation of the Bermuda Bay property require our AC units need to be up 11Feet. This is a new guideline from the city. Its happening at all the beach front properties as well. The insurance will not cover the cost of new city guidelines.
“If an owner chooses to refuse service, the Insurance will not cover that Unit. Owners must allow the Restoration company to comply with State laws by allowing them to do what has been instructed to do by FEMA and the Insurance guidelines. “
The City of St Petersburg just completed their last pickup of all debris and rubbish from from the street outside of our Gates. PLEASE DO NOT PLACE ANY MORE ITEMS OUT THERE. THE CITY IS DONE PICKING UP. If you have items to get rid of please make arrangements and take them to the local dump. Thank You

HOT OFF THE PRESS - RAPID REMEDIATION UPDATE...
Rapid Remediation is moving along. This week should be the sign off on 57, 62, and maybe 61. You will receive an email confirmation when it is okay to go back into your unit. Building 55 is waiting on abatement testing. Building 58 is awaiting drywall. 59 - the testing is done and they will be moving forward. Building 54 is in abatement. Rapid is requesting another crew to come in to do drywall, texturing, etc. to help speed the process along. It's good news - because there is positive progress. We hope to get everyone back into their units soon.
Some questions were brought up about about trim - here is the official skinny: Window and Door Trim are covered in the policy. Doors will also be covered. Baseboard trim is NOT.
Final quotes on AC installation have just come in - so they will be entered into the adjuster's quoting process. We are in the final stages of getting all of the expenses documented and getting it ready for submittal to insurance.
As we approach Phase II of the restoration - anything that was damaged, or left off, or needs redone - will be completed during this time. Right now we are concentrating on getting people back into their homes...the detail work comes after this first phase. We understand the frustration, but it is important to share any damages with Ray in the office, who is logging each concern for each unit. All will be addressed with Rapid.

Meet Your New Treasurer - Juergen Hofheinz
Hello, my name is Juergen Hofheinz and I am your new treasurer. I am retired from my 34 year career as a Purchasing Manager for J. Fletcher Creamer and Son, Inc. – a heavy highway and utility contractor. I am a part-time resident of Bermuda Bay, spending six months each year in residence in unit 49H. My wife, Karen and I thoroughly enjoy the people and the amenities of Bermuda Bay.
For the past three years, I have “helped” when volunteers were needed. I served on the Budget Committee the past two years under the direction of Mike Martin, Treasurer. I currently chair the Contracts Committee where I hope to assist the Board and Management with reviewing proposals and contracts (drawing on my 34 years of experience in the construction world), and summarizing the scope of work so Board members can make an educated decision.
I was committed to run after my most recent stay in October 2024. I was amazed how the BBB community came together after Helene and Milton. When I arrived, I was expecting a total mess, but I was amazed and heartened by how much had been cleaned up by the residents of BBB. This just proved to me that Community is alive and well in BBB, and that I am glad to be a part of it.
I ran for the Board because I want to help BBB come back from both the storms and the ongoing projects. I know, once completed, we will have a wonderful property again that everyone will be proud to live in.

It's Beginning To Look A Lot Like Christmas
Twas the Night Before Christmas
'Twas the night before Christmas, and all through the Bay,
Not a palm tree was swaying, no breeze led astray.
The stockings were propped on the windows with care,
For the balconies, sadly, just weren’t still quite there.
The condos stood bright, though still mid-repair,
With hopes that next Christmas, they’d all be square.
Neighbors stayed hopeful, with dreams in their sights,
Awaiting restorations and warm, cozy nights.
The sunsets still painted the skies with such grace,
A vibrant reminder of this special place.
Through storms and the trials, one truth has been clear,
Bermuda Bay’s beauty grows brighter each year.
We toasted together not long ago,
At our 50th party with hearts all aglow.
Through music and laughter, we honored the past,
And celebrated the strength of a spirit steadfast.
A big thanks to our staff, who deserve every cheer:

The APPROVED Budget for 2025
SO LET'S LOOK AT WHAT OUR RESERVE STUDY FOR THE NEXT THREE YEARS TELLS US
2025 - reserve costs projected in 2022 would be $1,487,685.00
2026 - reserve costs projected in 2022 would be $544,765.00
2027 - reserve costs projected in 2022 would be $860,578.00
Total: $2,893,028.00
This DOES NOT include the Balcony/Stair project, Hurricane damage, the $225K loan at 8% interest that we wanted to eliminate, nor does it include the Aticus study warning us about the underground water intrusion that can take place. (See September Special Financial newsletter for details). The Stair/Balcony project could be another $500,000.00 or more and the attorney fees moving forward protecting us from a law suit could be as high as $100,000.00 (All Estimations). Just some numbers to be thinking about We will also possibly need to include the shortfall of another $200,000.00+ in the special assessment to fund the reserve. We don't want to have continued special assessments every year.
The Board is considering TWO special assessments. One covering overages and hurricane damage that would be paid upfront...no monthly payments. The rest that would cover 2025 reserve projects that could be a monthly pay out. Many options are being looked at. NOTHING HAS BEEN DECIDED ON THIS FRONT. We don't know what the REAL balcony/stair costs are going to be and it is important that we are as transparent and correct with our numbers as we can possibly be. Everything is STILL IN DISCUSSION!
The only things that has been decided are your COA dues for 2025. (SEE ABOVE)
WE WILL BE ELIMINATING PAYMENT COUPON BOOKS, SO EVERYONE WILL NEED TO GET ONLINE TO MAKE THEIR PAYMENTS OR DO THEM DIRECTLY.
We will be providing some tutorials and assistance for those who are not familiar with paying online. The office will be more than happy to walk you through the process and assist with getting you set up.
- Since we found out it is illegal to give an incentive to those that pay upfront - those that did would not have to pay interest and fees associated with the monthly coupons.
BERMUDA BAY LEASING - WE NEED HELP
Since the abatement process has begun, residents must find places to stay while the asbestos is being removed from their units. This process takes a week and perhaps even longer if owners need to be out for cleaning, drying, and rebuilding. The Board is WAIVING the mandatory thirty (30) days and is seeking owners who would be willing to rent to Bermuda Bay residents who need a place to go. This is only being waived for Bermuda Bay residents who are being displaced during the restoration. Please consider providing this opportunity for your neighbors...we have so many who need a safe place and they want to be close to their units.
OTHERWISE...
Bermuda Bay has a MINIMUM 30 day lease policy...that means no lease is acceptable with less than 30 days. No leases under 30 days will be permitted. You must also have your $100.00 application fee accompanying your documentation or your lease will be refused. Most owners that lease - follow this policy, but for the few who do not, it could cause a very unpleasant circumstance when your poor tenant arrives. Please follow the rules -they are being enforced.
If you have a long term lease that has expired for over a month, you will be required to pay the application fee and update the lease information. Those that rent need to keep on top of expiration dates and keeping all rental agreements current and up to date. The Bermuda Bay office is not a leasing office. The responsibility falls on the owner.
Talk about the Special Assessment
The Board is talking about two special assessments. One will be for the overages of 2024. As these final numbers come in -we will be able to make a good decision on the amount needed. This will hopefully be a small amount to be paid in full.
The second assessment for 2025 will cover projects, such as finishing the balconies/stairs, paying off the high loan interest rate loan, fixing the gate, replacement of pipes, fencing, landscaping, and several other projects. This assessment would have a coupon book and could be paid over time or all upfront (whatever the preference of the owner will be). We have heard much discussion on this topic and the Board believes that most owners are in favor of a higher special assessment to avoid having another one in a few years. We will also need to consider replenishing the Reserve Fund as well.
Nothing has been formulated at this time on either assessment, so please remain patient as the Board will be as transparent as possible with each project, so the ownership can see the numbers and be fully informed on the decision making.

FOR YOU BOWL GAME LOVERS - HERE IS THE SCHEDULE
WORK ORDER SYSTEM - THAT MAKES "WORK REQUESTS" EASIER FOR YOU
Recently I've been alerted to the fact that several work orders have been closed prematurely, without the work being fully completed or even started in some cases. While it's fine to submit new work orders, a more efficient approach would be for owners to email me directly at bbbmanager@condominiumassociates.com and let me know the condition of the work.This way, I can reopen the existing orders. Reopening helps maintain the chronological order of the queue and preserves any existing notes or photos attached to the original work order.
Please continue to log all your requests and needs through work orders. We are now holding daily meetings to prioritize and ensure efficient, timely completion of these tasks.
Let's keep moving forward into the beautification of the property!

WE WISH THAT EVERYONE WOULD FILL OUT AN ARC FORM IF YOU ARE DOING ANY WORK IN YOUR UNIT
We ask that everyone will fill out an ARC application no matter what work you are doing, just for the record. Some work does not need any approval by the ARC committee, but your application will go into your permanent unit file for future reference if ever needed. It also lets us know what vendors will be on property to do work.
Other ARC work will need approval by the committee. Once it is approved by the ARC committee it is moved forward to the Board of Directors who will vote on it at a Board meeting. Plumbing, Electric, and Structural are major and need ARC committee approval. Second story flooring needs approval and a few other things as you can read below.
Also remember - per our new amendment to our documents - you must measure your balcony/lanai if you wish to keep your dimensions for the future. As continued work needs to be done - replacement will hinge on the documentation you are supplying now to the office.
Procedure to follow when filing an ARC application
Owner completes form and gives to office.
Office sends to ARC meeting
All NEW ARC forms MUST be submitted by the first Friday of each month so they can be added to the agenda in time for our Monthly meeting.
ARC holds its MONTHLY Meeting on the Second Wednesday of the Month
ARC committee makes our recommendations to the Board-We give to Board by the second Friday of the month so it can get added to board agenda and packet.
Board has meeting on THIRD WEDNESDAY of each month. They Vote.
Office Manager informs owner of Board decision and any adjustments or info is exchanged and documented.
Office Manager places ARC board notes etc… in the unit file for permanent record of work done within units.
Owner informs to Office Manager schedule of workers on the property. Contractor phone numbers should be on the ARC to help management if there is a problem or confusion of any kind.
HURRICANE REBUILD FORM FOR THOSE AFFECTED BY THE STORM
A Big Thanks To Our Outgoing Treasurer Mike Martin
The Board of Directors wanted to publicly thank Mike Martin for his service on the Board. During his two years, he jumped right into the fray and helped turn our understanding of the monies in a way that all of us could understand. He was a tireless volunteer and was always willing to help others at Bermuda Bay. We hope to see his smiling face soon and wish him all the best with his health and happiness.
As the sun sets on Bermuda Bay...
So it sets on another beloved member of our Bermuda Bay community. It is with a sad heart that I share the passing of Louis Wroblewski. He was in his summer home in Wisconsin. Louis purchased his condo in 1999 and loved being here each winter. Louis will be remembered with love as a great storyteller, a wonderful cook, his companionship during "cocktail time", and as a beloved neighbor. He leaves behind three daughters and his special friend Dee. Prayer go to the family and friends. Rest in Peace.
