New Amendment Addressing Parent Participation in the IEP Process
The Tennessee State Board of Education passed an amendment to the Special Education Programs and Services Parent Participation Rule. This amendment requires that if the schools create a draft of an Individual Education Plan (IEP), the parents will receive a copy at least 48 hours before the IEP meeting. This change will go into effect as of March 12, 2019. Parent input is a critical component of the IEP development process and this will provide parents time to review their student’s present levels and proposed goals prior to the meeting.
Will parents ALWAYS receive an advanced copy of an IEP draft?
Parents will be given the option to receive a copy of the draft IEP as part of the meeting notice.
A copy will be provided unless:
- Parent indicates in writing that they are declining their right to receive a copy of the IEP draft.
- The school did not prepare a draft IEP.
- The meeting is to review evaluation results for an initial evaluation.
A draft IEP is created to provide preliminary information for review and discussion. Communication with your child’s school based team is always encouraged.
